Complaint to Governor Jared Polis

 Dear Governor Polis,

I am writing to express my deep concern over an incident involving the Elbert County Sheriff’s Department that highlights the growing problem of militarized law enforcement in Colorado and its troubling implications for the relationship between citizens and those entrusted to protect their rights.

On January 11, 2025, an armored Humvee from the Elbert County Sheriff’s Department trespassed onto private property at (redacted) A man stationed on the roof of the vehicle aimed a deadly weapon at the property owner, Zachary Moore, under the guise of delivering a fraudulent eviction notice. Sheriff Tim Norton has reportedly threatened to return with the same equipment and use deadly force if Mr. Moore does not comply by midnight on January 19, 2025.

This incident illustrates the unnecessary and dangerous nature of militarized policing. The use of military-grade equipment to enforce civilian matters sends a psychological message of dominance and disparity, undermining trust between citizens and law enforcement. It creates an environment where those tasked with defending the rights of Coloradans are emboldened to act with impunity, disregarding the principles of rational self-governance. Instead of pausing to consider the sanctity of private property and individual rights, such equipment instills unwarranted confidence in those wielding it, empowering them to intimidate and threaten their fellow citizens.

Governor Polis, I ask you: Is Colorado a land where might makes right? Or do we uphold the principles of rational self-governance that ensure every citizen’s rights to life, liberty, and property? The actions of Sheriff Norton’s department reflect a dangerous shift away from the values that define a free and fair society.

I urge your office to take immediate steps to:

  1. Investigate this incident and the conduct of the Elbert County Sheriff’s Department to determine whether it aligns with constitutional protections.
  2. Order an immediate cease and desist against the eviction notice issued to me. I have been denied any semblance of legality in this process. No valid contract secured with valuable consideration has been presented, despite my documentation of this issue with the Sheriff’s Department, the courts, and the lender. I have repeatedly provided this documentation across multiple channels, including with the Consumer Financial Protection Bureau. Allowing this eviction to proceed under these circumstances would be a gross violation of due process and property rights.
  3. Review and reform policies that allow law enforcement agencies to acquire and use military-grade equipment, ensuring these tools are used appropriately, if at all, in civilian law enforcement.
  4. Establish accountability measures to prevent further abuse of power, ensuring law enforcement agencies serve their communities in good faith and with integrity.

Colorado’s citizens deserve a law enforcement system that upholds their rights and freedoms—not one that uses the tools of war to threaten them. The militarization of our police forces erodes the trust and cooperation necessary for effective governance and public safety. I trust that under your leadership, Colorado will take swift and decisive action to correct these troubling developments and reinforce the principles of democracy and justice that our state is built upon.
