Hearing Update: Lawless Courts and the Consent of the Governed
Hearing update: Replevin order granted without jurisdiction or injured party, exposing the Elbert County District Court as an illegitimate institution of lawlessness and removing its authority to rule.
“From the days of John the Baptist until now, the kingdom of heaven has been subjected to violence, and violent people have been raiding it.” (Matthew 11:12)
When I set out on this task, I knew it would be met with resistance. The very evidence of corruption, theft, and murder throughout our society is the evidence that people behave irresponsibly. Should we expect that legislatures, judges, or sheriffs are somehow made of finer clay than the criminals which they presume to govern?
The reality is that a peaceful society is one which the consent of the governed is the one and only rule that is honored as sacred and unquestionable. It is this law that defines the limits of actions and gives space for the love of creativity, productivity, and free exchange. Wherever this singular law is ignored, dismissed, and violated, there is no limits, no boundaries, and therefore no space for society. Without this law, civilizations collapse under the weight of corruption, theft, and murder.
Today I witnessed first hand the effects of a thousand laws, whims, wishes, and desires being honored except this one, my consent. A woman by the name of Theresa Slade, who claims to be a judge, presumed to rule over me without jurisdiction and presumed to enforce an order by a bank without a valid contract. She granted a replevin request without my consent. This was a singular ruling made by one individual, not a jury trial. This same Theresa Slade, who is no different than any other person who presumes something without evidence or logic, will likely use her same presumed authority to order the sheriff’s department of Elbert County to threaten my life in order to take possession of my property.
This isn’t to say that consent means anyone can do anything. If anyone violates the consent of another, they are by definition created an injured party who may seek remedy by the law of consent. During the hearing with Porsche Financial Services, I asked over and over for the judge Theresa Slade to dismiss PFS’s claims because no proof of loss had been established. Without proof of loss, there was no evidence of an injured party. Without evidence of an injured party, there was no evidence of violation of consent. And without evidence of a violation of consent, no remedy is possible. IN fact, any remedy ordered by the court would be by definition a violation of my consent, making me the injured party, and giving me grounds for seeking remedy against the very people whose authority rests on protecting my consent.
So… I knew this was not only possible but likely. The reason we are in this mess today and the reason society is falling apart is precisely because the institutions who claim to have a monopoly on protecting the consent of the governed are the very ones violating it! These are times that try the souls of men and compel us to cry out for the real law, not some substitute, a wolf in sheep’s clothing.
So now that this is all on the record, what do we do?
1. We communicate responsibly
Communication is the beginning of the law. Nobody knows who we are, what we own, or when we are injured unless we say something. That is what I am doing here. You should do this too. Write to your local sheriff, the sheriff in the county next door, and other constitutional sheriff’s in your area to let them know what is happening. 2. We act responsibly
Be very diligent that as you communicate that you first look within to ensure no one has a legitimate claim against you. “Take the log out of your own eye first and then you may clearly see the speck in your neighbors eye.” Of course, this always means that noticing the speck in your neighbors eye is a service to them. Who wants to have a speck in their eye?! But let’s serve our neighbors and be sure we have humbled ourselves first and foremost.
3. We serve each other
Of course we serve each other in our words and our actions. We also serve each other by defending each other. This act of service is the whole point of the courts and the sheriff’s yet isn’t it ironic that we defer the responsibility to others instead of taking it on ourselves? We have no rights to protection and cannot compel others to actively keep us from evil. However, if we stand by and do nothing while our neighbor is injured, what gives us any assurance that our neighbor will come to our defense? Edmund Burke has famously said “the only thing necessary for the triumph of evil is for good men to do nothing.” Today we have a lot of people who wish to benefit from liberty and society without participating in its security. Resolve today to right this wrong, take the oath to defend your own consent and the consent of your neighbors, and may the government by the people, for the people, and of the people be among us always.
Next steps for me are in alignment with this update. I will write to local law enforcement officers and friends informing them of the situation and appealing for their aid. I will write an appeal to the court system, corrupt as it may be, using my words responsibly and giving them opportunity to repent. And I will stand for my right to live, knowing that any man who wishes to improve their arguments with a gun is a killer, under serving of the very life by which he holds that gun against me.
May we hear the word of the Lord
“Some trust in chariots and some in horses, but we trust in the name of the LORD our God.” (Psalm 20:7)
And may we trust in the promises of Christ
“Let us run with perseverance the race marked out for us, fixing our eyes on Jesus, the pioneer and perfecter of our faith. For the joy set before him he endured the cross, scorning its shame, and sat down at the right hand of the throne of God. Consider him who endured such opposition from sinners, so that you will not grow weary and lose heart.
“In your struggle against sin, you have not yet resisted to the point of shedding your blood. And have you completely forgotten this word of encouragement that addresses you as a father addresses his son? It says
“My son, do not make light of the Lord’s discipline, and do not lose heart when he rebukes you, because the Lord disciplines the one he loves, and he chastens everyone he accepts as his son.
“Endure hardship as discipline; God is treating you as his children. For what children are not disciplined by their father? If you are not disciplined - and everyone undergoes discipline - then you are not legitimate, not true sons and daughters at all. Moreover, we have all had human fathers who disciplined us and we respected them for it. How much more should we submit to the Father of spirits and live! They disciplined us for a little while as they thought best; but God disciplines us for our good, in order that we may share in His holiness. No discipline seems pleasant at the time, but painful. Later on, however, it produces a harvest of righteousness and peace for those who have been trained by it.
“Therefore, strengthen your feeble arms and weak knees. Make level paths for your feet so that the lame may not be disabled, but rather healed. (Hebrews 12).
